OFFICIAL RULES

To enter this Contest, you must agree to and abide by these Official Rules.

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. YOU MUST HAVE INTERNET ACCESS AND AN INSTAGRAM ACCOUNT OR A TWITTER ACCOUNT TO PARTICIPATE.

 

Article 1 – Sponsor – Overall presentation of the Contest

The company G.H. MUMM ET CIE, SOCIETE VINICOLE DE CHAMPAGNE, SUCCESSEUR, limited liability company under French law capitalised at 61 311 069,00 euros with its head office at the following address 29, rue du Champ de Mars, 51100 Reims, registered at the Reims Trade Register under the number B 562 084 129 (herein after the « Sponsor»), hold a contest (herein after the « Contest »).

In the framework of the Contest, Entrants will send to the Sponsor, in accordance with the terms set out below, a video or a photo of their most daring goal celebration.

The final winner will be selected by Usain Bolt, Chief Entertainment Officer of G.H. Mumm.

 

Article 2 – Contest period

Entrants shall send their video or photo to the Sponsor from 2pm, June 14th, 2018 to 2pm, July 15 th, 2018 included (London date and time, the timestamp of the computer server used by or on behalf of the Sponsor shall prevail). Videos and photos submitted after that date will not be considered.

The winner will be announced on July 20th, 2018.

 

Article 3 – General conditions

By participating in the Contest, each entrant agrees to abide by and be bound by these Official Rules. Participation in the Contest implies the acceptance of all and each one of these rules without reservations. By participating, all entrants warrant and represent that they have complied in full with these Official Rules and further agree to be bound by these Official Rules and the decisions of Sponsor and/or the Contest organization or entity, which are final and binding in all respects.

The entrant declares to fulfil all the requirement set forth herein to participate in the Contest and to comply with all applicable legislation and regulation.

The Contest is open to natural person aged 18 years old or older at the time of entry, residing in a country where the Contest is not forbidden or contrary to laws and regulations. Internet access and a Twitter or Instagram personal account are required. Excluded from eligibility are employees of the Sponsor and of all entities involved directly or indirectly in the conception, organisation, creation, and/or management of the Contest.

The entry to the Contest by a person residing in a country where the Contest is forbidden, contrary to the legislation and regulation, is void.

Participation is contingent on strict adherence with all the steps described at article 5 of the current Official Rules.

Only participations complying with the Official Rules shall be taken into account in the Contest.

If an entrant is eliminated, he will be revoked of all his rights under this Official Rules and notably the ones linked to the award of the prize, whatever the time of elimination, including after the award of the prize.

 

Article 4 –  Content Guidelines

In addition to complying with all other requirements of these Official Rules; each video or photo and comment (if any) must comply with the following guidelines (“Content Guidelines”).

The Entrant undertakes not to post videos or photos which content is pornographic, shocking, violent, insulting, denigrating, defamatory or damaging to the reputation or image, contrary to public policy, morality or the applicable law and regulation, in any way.

Any video or photo (including comment) that Sponsor, in their sole discretion, determines is in violation of any Content Guideline will be disqualified from the Contest. Each video or photo and comment (if any) must not:

  • Contain content, image(s) or material that violates or infringes any third-party rights of any kind, including without limitation, any third party privacy, publicity, trade secret and/or intellectual property rights, including third party registered and/or common law copyrights and trademarks;
  • Disparage Sponsor (or any persons who endorses their products), any other person or entity affiliated with the Contest or products, services or entities that are competitive with any of the foregoing;
  • Contain brand names, trademarks or logos of any third party
  • Contain content, images, artwork or other creative elements not created by and original to Entrant;
  • Contain content, images or other material that is misleading, inappropriate, indecent, obscene, hateful, tortious, defamatory, slanderous or libellous; The Entrant undertakes notably not to post a video or a photo that will associate alcohol consumption with sport practice, that will include scenes of nudity, and showing persons under the influence of alcohol.  
  • Contain content, images or other material that reflects, advocates or promotes bigotry, racism, hatred, harm or exploitation of or against any class, group or individual, discrimination based on race, gender, religion, nationality, disability, sexual orientation or age, or actions or activities that are restricted, prohibited, illegal or unlawful (including without limitation, the consumption of alcohol or any other controlled substances);
  • Contain images of people under 18 years of age;
  • Contain content, images or other material that is unlawful or in violation of or contrary to any applicable laws or regulations;
  • Have been previously submitted in a promotion of any kind, or published, posted, exhibited or displayed publicly for commercial use by any means and in any form or media.

Only participations complying with this requirement of the Official Rules shall be taken into account in the Contest.

Article 5 –How to enter and winner selection

5.1       To enter the Contest, the Entrant shall post a video or a photo of his most daring celebration goal on his Twitter and/or Instagram account, tagging @ghmumm and using #NextVictory on Twitter and/or Instagram.

5.2       The Sponsor will pre-select the 20 best videos or photos, in consideration of the following criteria and with the following weight given to each such criterion:

A.  Aesthetic of the video or photo                                                                     25%

B.  Creativity and Distinctiveness of the goal celebration                              75%

Among the 20 remaining videos or photos, Usain Bolt, Chief Entertainment Officer of G.H. Mumm, will chose the video or the photo of the most daring celebration goal and chose the winner. Usain Bolt will select the video or the photo according to his tastes, his decision shall be within his sole discretion and shall not be subject to challenge or appeal.

The winner will be announced on July 20th, 2018.

The winner will be contacted by direct message from the Sponsor’s Instagram or Twitter account to the winner’s Instagram or Twitter account within approximatively one (1) week from the designation of the winner. The message will request that the winner email the Sponsor at the specified email address with specific personal information (ex: full name, address, phone number, email address, date of birth, Instagram and/or Twitter username etc.). It is recommended that you confirm your Instagram and/or Twitter notification settings are turned on and your Instagram and/or Twitter account is not set to "protected mode," or “private.”

 

Article 6 –  Prize

The prize is a Mathusalem of Mumm Champagne.

The prize will be shipped by the Sponsor to the winner at no expense for him.

The total approximate retail value of the prize is EUR. 500,00. The value of the Prize is determined at the time of writing the present Official Rules and shall not form the object of a challenge as to its evaluation.

The Sponsor reserves the right, if the circumstances so require, to substitute, at any time, of the indicated Prize, a Prize of equivalent commercial value.

 

Article 7 – Intellectual Property Rights and Image Rights – Assignment for the benefit of the Sponsor

7.1       The use of all or part of elements covered by an intellectual property right reproduced within the framework of the Contest, including the trademarks of the Sponsor, is strictly forbidden.   

7.2       The Entrant guarantees he is the exclusive holder of rights on the posted video or the posted photo.

In the light of this, the Entrant guarantees to the Sponsor that the video or the photo is not a counterfeit and will not infringe the right of third party in any way whatsoever. He guarantees notably that all persons who may appear on the posted video or photo accept for their image to be used and diffused.   

Consequently, the Entrant guarantee to the Sponsor against any trouble, action, claim, opposition and liability resulting from the video or the photo he posted to participate to the Contest.

7.3       The Entrant assigns, free of charge and on an exclusive basis, to the Sponsor, for the entire world, during the period of the Contest, then for a period of one year, the right to use the video or the photo in the entire world in any way whatsoever and, notably, for advertising and promoting its activities, goods and services, and also in regards to its marketing operations, its internal communication, external and/or institutional or the communication of the group of company to which it belongs, notably and without limitation by broadcast on the internet (included social network), television, by broadcast on mobile network; by printing, by representation on wireless devices, and on any support.

 

Article 8 –   Limitation of liability

8.1       The Sponsor shall not be held liable for all problems intrinsic to the internet connection, the functioning of Twitter and Instagram network, any technical failure or any other problem which is not attributable to the Sponsor and which may occur during the Contest period.

8.2       Entrants agree that the data contained in information systems of the Sponsor have evidential force until proven otherwise, regarding connexion and reception of posts and Entrants.

8.3       In the case in which the winner has not transmitted his identity and full address to the Sponsor to organise the prize award before the deadline has expired starting from the announcement of the winner, it will be considered that he has given up his right to claim it. The prize will not be awarded and shall not under any circumstances be subsequently claimed.

8.4       In the case in which the winner renounces expressly or tacitly to receive his prize, it will remain the Sponsor property who will keep it and may use it again in a further operation and the Sponsor responsibility shall not be engaged hence.

8.5       By its participation to the Contest, the Entrant certifies that the Contest is not contrary to any law and regulation in his country. The Sponsor shall not be held liable when the Prize could not be awarded given legal and regulatory constraints of its country of residence.

8.6       No liability shall be held against the Sponsor in case of injury, deterioration or damage arisen while the video or the photo is recorded by an Entrant or any other person who intended to participate to the Contest.

 

Article 9 –  Exclusion and examination

Entrants allow all examination, in compliance with applicable laws and regulations, regarding notably their identity, age, address in the framework of the Contest. All participation that does not comply with the present regulation/Official Rules, incomplete or with erroneous data will be considered as void.

 

Article 10 –  Force majeure

The Sponsor’s liability shall not be held if, in case of force majeure or event outside its control or if circumstances requires it, it will be lead to cancel the present Contest, to cut it short, extend it, defer it, post pone it, suspend it, or modify its conditions.

 

Article 11 –  Modification of the Official Rules

The Sponsor reserves its right to modify, at any time and without notice, all or part of the provisions of the present Official Rules, and notably to extend the participation time limit and/or to post pone all dates stipulated in the present Official Rules.

Those modification will not challenge the liability of the Sponsor

The potential changes of the Official Rules during the Contest will be published on https://www.mumm.com/en. Modifications shall be deemed to be accepted by the Entrants.

 

Article 12 –  Applicable law and disputes

This Contest shall be governed by and interpreted under the laws of Spain. By participating, entrants agree that any and all disputes arising out of or relating in any way to this Contest shall be litigated only in courts sitting in the city of Madrid. The courts of Madrid shall have sole jurisdiction of any controversies regarding the Contest and the laws of Spain shall govern the Contest. Each Entrant waives any and all objections to jurisdiction and venue in these courts and hereby submits to the jurisdiction of these courts.

 

Article 13 –  Protection of personal data

Personal data transmitted by Entrants are collected and electronically processed in order to manage the Contest and intended for the GH Mumm Company.

Your information may be used by GH Mumm and made available through it to any other entities of the Pernod Ricard Group to provide you with news and promotional information about GH Mumm. At any time, you can exercise your right of access, rectification, erasure, restriction, portability, objection or withdraw your consent at any time without affecting the lawfulness of processing based on your consent before withdrawal by contacting us at contact@ghmumm. You also have a right to lodge a complaint with the Supervisory Authority.
